1. About these terms
Presence Labs is a brand operated by Tecstrix Infosystem, a partnership firm established in India (referred to as “Presence Labs”, “we”, “us”, or “our”). By accessing this website, joining our waitlist, applying for early access, or placing an order, you agree to these Terms and Conditions.
If you do not agree to these terms, please do not use the website or place an order. These terms form an electronic record under applicable Indian law and do not require a physical or digital signature.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to place an order. A person under 18 may use the website or Sudo only with the involvement and supervision of a parent or legal guardian, who must place the order and accept these terms.
3. Product information and availability
Sudo is an evolving hardware and software product. Product images, demonstrations, specifications, features, packaging, and availability may change before dispatch as development and production continue. We will not make a material substitution that changes the essential nature of an accepted order without informing you.
The SDK is intended to be made available under its own licence. Sudo’s core firmware, personality engine, website, branding, product designs, and other proprietary materials remain owned by Presence Labs, its operator, or their licensors.
4. Preorders and regular orders
- We accept both preorders and regular orders when shown as available on the website.
- Payment is collected in full at checkout.
- Prices are displayed in Indian rupees unless stated otherwise. Any applicable taxes or charges will be shown at checkout.
- An order is subject to availability, payment authorization, fraud review, delivery coverage, and our acceptance.
- We may refuse or cancel an order for suspected fraud, pricing or listing errors, unavailable stock, unsupported delivery locations, or other reasonable operational or legal grounds.
Current preorders are expected to begin dispatching together in mid-October 2026. This is an estimated dispatch period rather than a guaranteed delivery date. If production is materially delayed, we will contact affected customers using the details provided with the order.
5. Payments
Payments are processed through PhonePe or another payment service displayed at checkout. The payment provider may apply its own terms and privacy policy. We do not store your complete card details, UPI credentials, or banking authentication information.
Your statement may identify the merchant as Tecstrix. You are responsible for providing accurate billing, contact, and delivery information and for ensuring that the payment method is authorized for your use.
6. Shipping and delivery
We currently deliver only within India. Shipping is governed by our Shipping Policy, which forms part of these terms. Delivery dates are estimates and may be affected by production, carrier capacity, weather, public restrictions, or events beyond our reasonable control.
7. Cancellations, returns, and refunds
We do not accept voluntary returns or exchanges for change of mind. Cancellation requests made before dispatch require a genuine reason and our approval. Defective, damaged, incorrect, or unfulfilled orders are handled under our Cancellation and Refund Policy and applicable law.
8. Limited warranty
Sudo includes a six-month limited warranty beginning on the date of delivery. The warranty covers manufacturing defects under normal and intended use. It does not cover accidental or liquid damage, misuse, neglect, normal wear, cosmetic damage, use with an unsuitable power supply, unauthorized repair or modification, or issues caused by third-party hardware, software, APIs, or services.
For an approved warranty claim, we will bear reasonable shipping costs and may, at our discretion and subject to applicable law, repair the product, replace it, or issue a refund. Proof of purchase, the product serial number, and reasonable evidence of the issue may be required. Availability of paid out-of-warranty repairs is not guaranteed.
9. Software, AI, and third-party services
Some Sudo features may depend on internet access, third-party AI providers, APIs, local hardware, or services selected by you. Those services may have separate terms, charges, availability limits, and data practices. You are responsible for your chosen services and API credentials.
AI-generated responses may be inaccurate or unsuitable. Sudo is not intended for medical, emergency, safety-critical, legal, financial, or security use, and its responses should not be relied upon as professional advice.
10. Acceptable use
You must not use the website, Sudo, its SDK, or related services to:
- break applicable law or infringe another person’s rights;
- harass, threaten, deceive, surveil, or collect information about others without authorization;
- introduce malware, disrupt services, bypass security controls, or gain unauthorized access;
- use the product in a dangerous, safety-critical, or unlawful system; or
- misrepresent your affiliation with Presence Labs or resell access in a misleading manner.
11. Intellectual property
Except for the limited right to use the website and purchased product for their intended purpose, no intellectual-property rights are transferred to you. You retain ownership of original mods, integrations, and characters you create, subject to the rights in our SDK, runtime, interfaces, and other underlying technology and to any separate SDK licence.
12. Privacy
Our Privacy Policy explains how we collect and handle information. By using third-party payment or AI services, you may also provide information directly to those providers under their own policies.
13. Disclaimers and liability
To the extent permitted by law, the website and pre-release information are provided on an “as available” basis. We do not promise that every website or cloud feature will be uninterrupted, error-free, or permanently available.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss, lost profits, lost data, or losses caused by third-party services or use outside the product’s intended purpose. Our aggregate liability relating to an order will not exceed the amount you paid for that order. Nothing in these terms excludes liability or customer rights that cannot lawfully be excluded.
14. Events beyond our control
We are not responsible for delay or failure caused by events beyond our reasonable control, including natural events, transport disruption, labour disputes, government action, widespread service outages, component shortages, or carrier delays. We will take reasonable steps to communicate material order delays.
15. Changes to these terms
We may update these terms as our products, services, or legal obligations change. The current version and effective date will be posted here. Terms applicable to an accepted order will not be changed retroactively in a way that removes rights already accrued, except where required by law.
16. Governing law and disputes
These terms are governed by the laws of India. We encourage you to contact us first so we can try to resolve any concern. Subject to applicable consumer law, courts in Agra, Uttar Pradesh will have jurisdiction over disputes relating to these terms or an order.
