1. Who is responsible for your information?
Presence Labs is a brand operated by Tecstrix Infosystem, a partnership firm established in India. For questions, requests, or complaints about this policy, email support@presencelabs.in.
2. Scope
This policy covers the Presence Labs website, waitlist and early-access applications, purchases, delivery, warranty support, and communications with us. Detailed notices for Sudo’s device, voice, AI, memory, and cloud features may be provided separately before those services are activated and will supplement this policy.
3. Information we collect
Information you provide
- Waitlist information: your email address and the date you joined.
- Order information: your name, email, telephone number if supplied during checkout, billing and delivery addresses, products ordered, and order history.
- Payment information: transaction references, payment status, amount, and limited payment-method details received from PhonePe. We do not store complete card, UPI, or banking credentials.
- Support information: messages, photographs, videos, proof of purchase, product serial numbers, and other information you send for delivery, cancellation, warranty, or privacy requests.
Information collected automatically
Our hosting and security providers may process basic technical information such as IP address, browser type, device type, requested pages, timestamps, and diagnostic or security logs. We do not currently use advertising cookies, behavioural advertising pixels, or third-party analytics on this website.
4. How we use information
We use information where reasonably necessary to:
- operate, secure, maintain, and improve the website;
- manage the waitlist and early-access applications;
- process payments, accept orders, and provide order updates;
- dispatch products and investigate delivery issues;
- provide support, warranty service, repairs, replacements, or refunds;
- prevent fraud, abuse, unauthorized transactions, and security incidents;
- maintain business and transaction records and comply with law; and
- send communications you have requested or consented to receive.
Waitlist emails are used to review and manage early access. If your application is approved, we may send relevant product and order updates. We do not use your email for unrelated promotional marketing unless you have requested or consented to it.
5. How we share information
We do not sell your personal information. We may share only what is reasonably needed with:
- PhonePe and financial partners to process and verify payments, refunds, and suspected fraud;
- Vercel for website hosting, delivery, security, and operational logs;
- MongoDB for waitlist and application data storage, currently using infrastructure located in Mumbai, India;
- shipping and logistics providers to deliver and track your order;
- professional advisers and contractors who support our operations under appropriate obligations; and
- government, regulatory, or law-enforcement authorities when required by law or reasonably necessary to protect rights, safety, and security.
Third-party providers process information under their own terms and privacy practices where they act independently, including when you use PhonePe or a third-party AI endpoint.
6. Storage and international processing
Waitlist data is stored through MongoDB infrastructure in Mumbai. Vercel and other providers may process limited website information in other locations as part of their global infrastructure. Where information is processed outside your location, we use reputable providers and take reasonable steps appropriate to the nature of the information.
7. Retention
We retain waitlist information until you ask us to remove it, the waitlist closes, or it is no longer reasonably needed. Order, payment, shipping, tax, warranty, and dispute records may be kept for as long as reasonably required for support, fraud prevention, contractual obligations, and applicable legal or accounting requirements. Support evidence is retained only for as long as needed to handle the request and related records.
8. Your choices and rights
You may ask us to provide access to, correct, or delete information you supplied, withdraw consent for optional communications, or stop sending product updates. Email your request to support@presencelabs.in from the address associated with your request or order. We may need to verify your identity and may retain information where law or a continuing contractual need requires it.
9. Cookies
We do not currently use advertising or analytics cookies. The website or its infrastructure may use strictly necessary technologies for security, network delivery, fraud prevention, and essential operation. If we introduce non-essential cookies, we will update this policy and provide any consent controls required by law.
10. Security
We use reasonable technical and organizational safeguards appropriate to an early-stage online business, including reputable hosting and payment providers and restricted access to stored data. No internet transmission or storage system can be guaranteed completely secure, so please do not send sensitive payment credentials through email.
11. Children
Purchases are intended for adults who can enter a binding contract. We do not knowingly invite children to submit personal information or place orders independently. A parent or legal guardian should contact us if they believe a child has submitted information without appropriate involvement.
12. Third-party links
Our website links to social networks and may link to payment, AI, or other services. We are not responsible for their independent privacy practices, and you should review their policies before providing information.
13. Updates to this policy
We may update this policy when our website, products, service providers, or legal obligations change. The revised version will be posted here with a new effective date. Material changes may also be communicated through the website or email where appropriate.
