1. Who is responsible for your information?
Presence Labs is a brand operated by Tecstrix Infosystem, a partnership firm established in India. For questions, requests, or complaints about this policy, email support@presencelabs.in.
2. Scope
This policy covers the Presence Labs website, waitlist, Founder preorders, purchases, delivery, warranty support, and communications with us. Detailed notices for Sudo’s device, voice, AI, memory, and cloud features may be provided separately before those services are activated and will supplement this policy.
3. Information we collect
Information you provide
- Waitlist information: your email address and the date you joined.
- Order information: your name, email, telephone number, delivery address, selected payment plan, policy acceptance, products ordered, and order history.
- Payment information: Razorpay order and transaction references, payment and refund status, amount, currency, and limited payment-method information. We do not store complete card, UPI, OTP, or banking credentials.
- Support information: messages, photographs, videos, proof of purchase, product serial numbers, and other information you send for delivery, cancellation, warranty, or privacy requests.
- Optional communications: whether you asked to receive occasional product updates.
Information collected automatically
Our hosting and security providers may process basic technical information such as IP address, browser type, device type, requested pages, timestamps, and diagnostic or security logs. We use pseudonymous keyed identifiers to rate-limit checkout and order-link requests without storing the source email or IP address in the rate-limit record.
We use Vercel Web Analytics and PostHog to understand visits to public pages, referring websites and campaign sources, browser and device categories, approximate location, clicks, scrolling, time spent viewing sections, and website performance. We also record preorder steps such as the selected payment plan, submission attempts, validation failures by field name, payment-window openings and dismissals, and successful payment verification with the amount and currency. This helps us identify confusing content and problems that prevent visitors from completing a purchase.
PostHog provides heatmaps and, when recording is enabled, session replays that reconstruct interactions with our public website. These replays do not record your camera, microphone, or activity outside our website. We mask form inputs and dynamic checkout messages, exclude private order and confirmation pages and payment-provider frames, and disable recording of browser console logs and network request or response bodies and headers.
We remove query parameters and URL fragments from analytics page URLs and limit referring-page URLs to their website origin. Campaign labels, such as UTM source and campaign, may be retained separately for attribution. We do not send checkout form entries, payment credentials, or private order access tokens as analytics events, and we do not attach your name, email, or delivery address to the analytics visitor identifier. We do not use behavioural advertising pixels.
4. How we use information
We use information where reasonably necessary to:
- operate, secure, maintain, and improve the website, including measuring section engagement and investigating checkout difficulties;
- manage the waitlist and Founder availability;
- process and verify payments, accept orders, and provide order updates;
- send expiring private order links, confirmations, and balance reminders;
- dispatch products and investigate delivery issues;
- provide support, warranty service, repairs, replacements, or refunds;
- prevent fraud, inventory abuse, unauthorized transactions, and security incidents;
- maintain business and transaction records and comply with law; and
- send optional communications you requested or consented to receive.
5. How we share information
We do not sell your personal information. We may share only what is reasonably needed with:
- Razorpay and financial partners to create, process, verify, reconcile, and refund payments and investigate suspected fraud;
- Resend to deliver order confirmations, expiring private links, balance reminders, and requested product email;
- Vercel for website hosting, scheduled jobs, delivery, security, operational logs, and aggregate website analytics;
- PostHog for public-page usage analytics, heatmaps, masked session replays, and preorder funnel analysis; see PostHog’s Privacy Policy;
- MongoDB for waitlist, order, payment-reference, inventory, and event storage, currently using infrastructure located in Mumbai, India;
- shipping and logistics providers to deliver and track your order;
- professional advisers and contractors who support our operations under appropriate obligations; and
- government, regulatory, or law-enforcement authorities when required by law or reasonably necessary to protect rights, safety, and security.
Third-party providers process information under their own terms and privacy practices where they act independently, including when you use Razorpay or a third-party AI endpoint.
6. Storage and international processing
Waitlist and order data is stored through MongoDB infrastructure in Mumbai. Analytics and session-replay information is processed separately by Vercel and PostHog and may be processed outside India. Vercel, PostHog, Razorpay, Resend, and other providers may process limited information in other locations as part of their infrastructure. Where information is processed outside your location, we use reputable providers and take reasonable steps appropriate to the nature of the information.
7. Retention
We retain waitlist information until you ask us to remove it, the waitlist closes, or it is no longer reasonably needed. Order, payment, shipping, tax, warranty, and dispute records may be kept for as long as reasonably required for support, fraud prevention, contractual obligations, and applicable legal or accounting requirements. Rate-limit records expire automatically after their short security window. Private order links expire after seven days and can be reissued after matching the order ID and email. Support evidence is retained only for as long as needed to handle the request and related records.
Analytics events and session replays are subject to the retention available under our providers’ service plans and, where configurable, our project settings. These periods can differ from the retention of order and payment records. You can contact us for information about the current retention settings or to request deletion of analytics information that can be linked to you.
8. Your choices and rights
You may ask us to provide access to, correct, or delete information you supplied, withdraw consent for optional communications, or stop sending product updates. Email your request to support@presencelabs.in from the address associated with your request or order. We may need to verify your identity and may retain information where law or a continuing contractual need requires it.
Browser privacy tools and content blockers can restrict analytics requests. Because our analytics identifiers are not linked to your email or order, an email address alone may not be enough to locate a particular visit. If you make an analytics-related privacy request, we may ask for additional information to help locate the relevant data.
9. Cookies, browser storage, and embedded video
Vercel Web Analytics does not use cookies. Our PostHog integration uses browser local storage and session storage to keep pseudonymous visitor and session identifiers and relate visits and checkout steps. This is analytics storage, not storage required to place an order. Clearing site data removes locally stored identifiers but does not delete analytics already sent to our providers or prevent a new identifier from being created on a later visit when analytics is allowed. The website or its infrastructure may also use strictly necessary technologies for security, network delivery, fraud prevention, and essential operation.
Our launch film uses YouTube’s privacy-enhanced player. Loading the player connects your browser to YouTube, and interacting with it may involve YouTube’s own storage and data processing. See Google’s Privacy Policy for details.
10. Security
We use reasonable technical and organizational safeguards appropriate to an early-stage online business, including reputable hosting and payment providers, server-side payment verification, expiring signed order links, restricted access to stored data, and request throttling. No internet transmission or storage system can be guaranteed completely secure, so please do not forward private order links or send payment credentials through email.
11. Children
Purchases are intended for adults who can enter a binding contract. We do not knowingly invite children to submit personal information or place orders independently. A parent or legal guardian should contact us if they believe a child has submitted information without appropriate involvement.
12. Third-party links
Our website links to social networks and may link to payment, AI, or other services. We are not responsible for their independent privacy practices, and you should review their policies before providing information.
13. Updates to this policy
We may update this policy when our website, products, service providers, or legal obligations change. The revised version will be posted here with a new effective date. Material changes may also be communicated through the website or email where appropriate.
